Welcome to Spectral Compute ("we", "us", "our"). We are committed to protecting and respecting your privacy. This Privacy Policy explains how we collect, use, and protect the personal data of visitors to our website and of people who register for updates about SCALE, our software.

This policy applies to all visitors of our website(s), including our documentation at docs.scale-lang.com, and to everyone who registers for SCALE updates.

We keep our data collection to a minimum. The data we process depends on how you interact with our site.

3.1. Data We Collect Automatically (Website Usage Data)

When you visit our website, we automatically collect certain technical information about your device and browsing activity.

Analytics Data (via Google Analytics and Microsoft Clarity):
- Data Collected: Anonymized IP address, geographic location (country and city level), browser type and version, operating system, device type, pages visited, time spent on pages, links clicked, scroll behaviour, and the referring website.
- Purpose: To analyze website traffic and user behaviour in an aggregated manner. This helps us understand what content is popular, improve the user experience, and make better business decisions.
- Legal Basis: Your explicit Consent, which you provide through our cookie consent banner before any analytics cookies are set.
Visitor-Identification Data (via RB2B):
- Data Collected: IP address, approximate geographic location, referring URL, browser and device information, and unique identifiers stored in cookies. RB2B matches this data against identity records held by RB2B and its partners, which may yield person-level profile information about business visitors, such as name, business email address, job title, company, and LinkedIn profile URL.
- Purpose: To identify the companies and, where available, the individual professionals visiting our website, so we can understand commercial interest in our products and carry out business-to-business outreach.
- Legal Basis: Your explicit Consent, which you provide through our cookie consent banner before any RB2B cookies are set or any identification takes place.
Data from Embedded Content (Social Media Feeds):
- Data Collected: Our website may feature embedded content from social media platforms such as Reddit and X (formerly Twitter). When you view a page containing this content, these third-party services may collect data directly from you, including your IP address, browser information, and they may set their own cookies to track your activity.
- Purpose: To display dynamic social media content on our website.
- Legal Basis: Your explicit Consent to allow non-essential cookies and content from these platforms, managed via our cookie consent banner. We do not control the data collection or tracking performed by these third parties. We recommend you review their privacy policies:

3.2. How You Can Manage Your Analytics and Visitor-Identification Data

You have control over the collection of analytics and visitor-identification data. You can manage your preferences by:

Installing the Google Analytics Opt-out Browser Add-on, which is available here.
Managing your preferences through our cookie consent banner, where you can refuse consent for analytics and visitor-identification cookies, including Google Analytics, Microsoft Clarity, and RB2B.

3.3. Data You Give Us When You Register for SCALE Updates

Our documentation offers a form to register for updates about SCALE. Registering is optional: you can download and use SCALE without it.

Data Collected: your email address (required); and, only if you choose to answer, how you heard about SCALE, what you want to run with it, the name of the project you want to run, and your Discord username. If you then follow the link in our welcome email to finish the survey, also (again only if you answer) what you will use SCALE for, your GitHub username, which GPUs and roughly how many you want to run on, and what has held you back so far. We also record the date and time of your registration and the documentation page you registered from. If you use a work email address, its domain tells us which organisation you work for.
Purpose: to send you a welcome email and, after that, emails about SCALE releases, new GPU support and related news; to understand who uses SCALE and how people find it, so we can improve it and decide where to spend our effort; and, if you give us your Discord username, to invite you to the SCALE community on Discord and contact you there.
Contact from our team: if your email address belongs to an organisation that could use SCALE commercially, a member of our business team may contact you personally about how SCALE could work for your organisation.
Legal Basis: yourConsent, which you give by registering, for update emails and the Discord invitation. Our Legitimate Interestin understanding our users and in offering SCALE to organisations that may need it, for the analysis and the personal contact described above. You can object to either at any time (see section 8).
Not linked to analytics: we do not link your registration to the analytics data described in section 3.1 (Google Analytics, Microsoft Clarity, RB2B) or to any other tracking identifier, unless you have accepted analytics cookies.

If you sign up for our newsletter on this website, we process the following data:

Data Collected: Your email address, the page you signed up from (for example, the page for an event where you met us), the date you signed up and confirmed, and whether you open our emails and click their links.
Purpose: To send you our newsletter about SCALE: releases, technical articles and the events where you can find us, and to understand which pages and events bring subscribers and which content is read.
Legal Basis: Your Consent. After you sign up, we email you a link to confirm, and we only send the newsletter once you have clicked it.
Withdrawing Consent: Every newsletter contains an unsubscribe link. You can also write to us at the contact email above.

We do not sell your personal data. We only share it with trusted third-party service providers who act as "data processors" on our behalf, as described below:

Google LLC: For providing website analytics services.
Microsoft Corporation: For providing Microsoft Clarity analytics services.
GetEmails, LLC (d/b/a RB2B): For providing visitor-identification services. RB2B also matches visit data against identity records it holds in order to provide us with person-level profile information; see the RB2B Privacy Policy for details.
The Rocket Science Group LLC (Mailchimp): For storing newsletter subscribers and sending our newsletter.
Reddit, Inc. & X Corp.: For providing embedded content functionalities.
HubSpot, Inc.: For storing the details of people who register for SCALE updates and managing our contact with them.
Google LLC: Also for keeping our internal list of contacts (Google Sheets), which includes people who register for SCALE updates.
Resend (Plus Five Five, Inc.): For sending the welcome email and other emails from our website.
Discord Inc.: If you join the SCALE community on Discord, Discord processes your data under its own privacy policy.
Legal Authorities: We may be required to disclose your data if required by law or in response to a valid legal request from a public authority.

5. International Data Transfers

The data we collect may be transferred to, and stored at, a destination outside the European Economic Area (EEA) and the United Kingdom, specifically the United States. When we do so, we ensure it is protected by implementing appropriate safeguards, such as the EU-U.S. Data Privacy Framework, the UK Extension to that framework, or by using Standard Contractual Clauses (SCCs).

6. Data Security

We have implemented appropriate technical and organizational security measures to protect your personal data. These measures include:

Encryption: Using SSL/TLS (HTTPS) encryption to protect data transmitted to and from our website.
Access Control: Limiting access to personal data to only those employees and trusted partners who have a legitimate business need to know.
System Security: Regularly updating our website's software, plugins, and server environment to protect against known vulnerabilities.
Network Security: Employing firewalls and security monitoring to prevent unauthorized access to our systems.

7. Data Retention

We retain your personal data for no longer than is necessary.

Google Analytics Data: User-level and event-level data is stored for a period of 14 months before being automatically deleted.
Microsoft Clarity Data: Session and interaction data is retained according to our Microsoft Clarity account settings and Microsoft's standard retention periods.
RB2B Data: Identifiers stored in RB2B cookies persist for up to one year (per-cookie lifetimes are listed in our Cookie Policy). Identification data held by RB2B is retained according to RB2B's own retention policy.
Registration Data: kept for as long as you stay registered. If you unsubscribe or ask us to delete it, we delete it within one month, keeping only a record that you unsubscribed so we do not email you again.
Newsletter Data: Kept for as long as you are subscribed. When you unsubscribe, we keep only a record that you did, so that you are not emailed again; you can ask us to delete it.

8. Your Data Protection Rights

Under the UK and EU GDPR, you have the following rights regarding your personal data:

Right of Access, Rectification, Erasure, Restriction, Portability, and Objection: As detailed in previous versions of this policy.
Right to Withdraw Consent: Where we rely on your consent to process data, you can withdraw that consent at any time.

Withdrawing your consent is a straightforward process that can be done via our cookie consent management tool. Please note that withdrawal of consent does not affect the lawfulness of any processing that occurred before you withdrew it. Withdrawing consent for analytics or embedded content will not break the core functionality of our website. You will still be able to browse our pages, though some embedded elements (like social media feeds) may not display.

You also have the right to lodge a complaint with a supervisory authority (e.g., the ICO in the UK or the Autoriteit Persoonsgegevens in the Netherlands).

If you registered for SCALE updates, you can stop them at any time with the unsubscribe link at the bottom of each of our emails. To have your registration deleted, write to the address above.
